On November 3, 2025, Michael Bushey, 69 of Saratoga Springs, NY a victim that was struck by a vehicle being driven by Besaw on October 16, 2025, died at Albany Medical Center. 

The investigation is ongoing.

On October 17, 2025, State Police with the assistance of the Saratoga County Sheriff’s Office arrested Timothy W. Besaw, 34 of Gansevoort, NY for Assault in the first degree, Assault in the second degree, Vehicular Assault in the first degree, Vehicular Assault in the second degree, Petit Larceny, Driving While Intoxicated and leaving the scene of an accident without reporting.

On October 16, 2025, at about 11:10 p.m. Troopers responded to the Walmart in Wilton, NY for the report of a disturbance. En route to the location Troopers were advised that two pedestrians had been intentionally struck by a vehicle. The investigation determined Besaw had been stopped by an employee as he was reportedly attempting to exit the store with merchandise he had not paid for. The merchandise he was carrying was recovered but Besaw then left the store wearing merchandise he had allegedly not paid for. He remained in the parking lot for a short period and engaged in a verbal altercation with an employee of the business. Following the argument Besaw entered a vehicle and reportedly drove it intentionally into pedestrians standing near the entry to the business and struck two employees with the vehicle. One of the victims he struck was the individual he had been in a verbal altercation with. Both pedestrians sustained serious but non-life-threatening injuries.

Besaw fled the location in his vehicle. Saratoga County Sheriff’s Office located Besaw, and the vehicle crashed off the roadway of Perry Road where he was taken into custody. Besaw was transported to SP Wilton for processing where he refused to provide a breath sample to determine the alcohol content of his blood. A blood sample was later taken at Glens Falls Hospital and is awaiting laboratory testing to determine the drug and alcohol content of his blood.

Besaw was arraigned at the Wilton Town Court where he was remanded to the Saratoga County Correctional Facility in lieu of $50,000 cash or $100,000 bond.
