Three Arrested Following ATV Crash on Dutchess Rail Trail

On June 21, 2025, Troopers from SP Poughkeepsie responded to a report of an All-Terrain Vehicle (ATV) crash with injuries on the Dutchess Rail Trail in the Town of LaGrange.

Upon arrival, Troopers located two injured individuals: the operator, Nicholas J. Hunt, 24, of Putnam Valley, NY, and the passenger, Devon A. Muscat, 25, of Newburgh, NY. Both sustained what are believed to be non-life-threatening injuries.

Investigation determined that Hunt was intoxicated at the time of the crash. However, the ATV involved was not located at the scene.

A thorough investigation by Troopers revealed that Justin M. Mooney, 25, of Poughkeepsie, NY, and Cullum R. Pavone, 26, of Wappingers Falls, NY, conspired to intentionally remove and conceal the ATV, thereby tampering with evidence related to the incident.

As a result of the investigation:

• Nicholas J. Hunt was arrested and charged with Driving While Intoxicated (DWI), first offense. He is scheduled to appear in the Town of LaGrange Court at a later date.
• Justin M. Mooney and Cullum R. Pavone were arrested and charged with Tampering with Physical Evidence, a Class E felony.
• Justin M. Mooney was additionally charged with Making a Punishable False Written Statement, a Class A misdemeanor.

Mooney and Pavone are scheduled to appear in the Town of LaGrange Court on August 5, 2025.

The investigation remains ongoing.
