

On May 1, 2025, at approximately 7:30 p.m., while on routine patrol, a New York State Trooper observed a disabled vehicle stopped on the left shoulder of Interstate 87 in the area of mile marker 18.8 in the hamlet of West Nyack, Rockland County.
Upon approaching the vehicle, the Trooper observed a male subject seated in the driver’s seat. The operator was identified as Kenny Varma. During the interview, the Trooper noted that Varma exhibited signs of impairment, including the odor of an alcoholic beverage emanating from his breath.
Varma was asked to exit the vehicle and submit to Standardized Field Sobriety Tests (SFSTs), which he performed and subsequently failed. He was taken into custody and transported to State Police Tarrytown for processing.
While at SP Tarrytown, Varma was read the DWI refusal warnings at approximately 8:00 p.m. and refused to submit to a chemical breath test.
An investigation determined that Varma had a prior DWI conviction within the past 10 years. As a result, he was charged with the following:
- Driving While Intoxicated (Felony) – Vehicle and Traffic Law §1192.3
- Refusal to Submit to a Chemical Test – VTL §1194.1(b)
- Driving on the Shoulder – VTL §1131
- Unsafe Lane Change – VTL §1163(e)
- Stopping/Standing on the Highway – VTL §1202(a)(1)(j)
Varma was issued appearance tickets returnable to the Town of Clarkstown Court and released to a sober third party.
