Although New York State law requires all front seat occupants and rear seat occupants under age 16 to be properly restrained, it is safest for all occupants, regardless of age, to be restrained in a motor vehicle at all times.

Police accident report data from DMV indicate that the greatest number of unrestrained motorists killed every year from 1999 to 2003 were between 16 and 44 years of age.

There was also a greater prevalence of death for unrestrained persons over 64 years of age. Overwhelmingly, more males are killed than females, by about a 3:1 ratio.
